These Terms of Service ("Terms") govern your use of the Diced Fitness mobile application and website (collectively, the "Service") operated by Diced Fitness LLC ("Diced," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 13 years old to use the Service. By creating an account, you represent that you are at least 13 years of age. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
To use certain features of the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use.
Diced Fitness provides a dice-based workout generation tool for personal fitness use. You agree to use the Service only for its intended purpose and in compliance with all applicable laws. You may not:
Diced Fitness may offer free and premium subscription tiers. Premium features, pricing, and billing terms will be clearly disclosed before purchase. Subscriptions may auto-renew unless canceled before the end of the current billing period. Refunds are handled in accordance with the policies of the applicable app store (Apple App Store or Google Play Store).
All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, software, and the dice-based workout mechanic — are owned by Diced Fitness LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
You retain ownership of any data you submit to the Service (such as custom exercises or workout logs). By using the Service, you grant us a limited license to store and process this data solely to provide and improve the Service for you.
Diced Fitness may partner with gyms and fitness facilities. If you are linked to a partner gym, the gym administrator may have limited visibility into your account (such as email and workout count) as described in our Privacy Policy. Gym partnerships do not alter your rights under these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DICED FITNESS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF PROFITS, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.
You acknowledge that physical exercise involves inherent risks, including the risk of injury. By using Diced Fitness, you assume full responsibility for your physical activity and agree that Diced Fitness is not liable for any injury, illness, or health condition that may result from workouts performed using the Service. You may delete your account at any time through the app's Settings screen. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.
We may update these Terms from time to time. We will notify you of material changes through the app or by email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Service and delete your account.
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Diced Fitness LLC is incorporated, without regard to conflict of law principles.
